3. Subscription Terms

For action links sent to individuals without accounts, the organization administrator is responsible for ensuring these links are only sent to appropriate recipients for legitimate safety correction purposes.
5. Action Links
Our action link system allows organizations to send secure, unique links to assignees for issue resolution without requiring account creation. By using this feature, you agree:
- To only send action links to appropriate individuals for legitimate purposes
- That you have obtained necessary permission to contact these individuals
- Not to use this feature for spam, harassment, or any unlawful purpose
- That action links have limited lifespans and may expire
- That action link recipients are bound by these Terms of Service when using the link
6. Content Ownership and License
You retain ownership of all content you upload to our service, including inspection data, photographs, reports, and other materials. However, you grant FixTraq a worldwide, non-exclusive, royalty-free license to use, reproduce, and process this content solely for the purpose of providing and improving our services.
You represent and warrant that you own or have the necessary rights to all content you upload to our service and that this content does not violate any third-party rights.
7. Acceptable Use
When using our services, you agree not to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use our services to transmit malware or harmful code

While our platform is designed to assist with safety compliance and issue management, we do not guarantee that use of our services will ensure complete compliance with all applicable safety regulations or prevent all safety incidents. Organizations remain responsible for their compliance obligations and safety outcomes.
9. Limitation of Liability
In no event shall FixTraq or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use our services, even if FixTraq or a FixTraq authorized representative has been notified orally or in writing of the possibility of such damage.
Our maximum liability for any claims arising under these terms shall be limited to the amount paid by you for the service in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless FixTraq, its affiliates, officers, agents, employees, and partners from any claims, losses, liabilities, demands, or damages, including reasonable attorneys' fees, arising out of your use of our services, your violation of these Terms, or your violation of any rights of another party.
